Full summary

Royal Decree 1312/2024, of 23 December (BOE-A-2024-26931), created the Unique Short-Term Rental Register, mandatory from 1 July 2025. Every property advertised for short-term rental on platforms with online booking and payment (Airbnb, Booking.com, etc.) was required to hold a Unique Rental Registration Number (NRA/NRUA).

Annulment by the Supreme Court

The Supreme Court, via ruling no. 620/2026, of 19 May 2026 (ECLI:ES:TS:2026:2148, published in the BOE on 8 June 2026), declared the Unique Register procedure null and void, finding that the State lacks constitutional competence to create a national register that overlaps with existing regional tourism registers.

What has been annulled

  • The obligation to obtain the NRA/NRUA through the College of Property Registrars.
  • The obligation to submit the annual rental declaration to the central state register.
  • The NRA as a mandatory condition for advertising on Airbnb, Booking and Vrbo.

What remains in force

  • The Digital Single Window for Rentals and platform data transmission obligations (based on EU Regulation 2024/1028, which was not annulled).
  • All regional regulations: VUT licence from the Junta de Andalucía, responsible declaration, code VUT/MA/XXXXX.
  • The SES.HOSPEDAJES obligation (RD 933/2021).
  • All tax obligations under IRPF/IRNR.

Situation in Andalusia

The code VUT/MA/XXXXX is now the only valid and required identifier for advertising on Airbnb and Booking. Platforms verify the regional code, not the NRA.

Claiming damages from the State

Those who incurred costs related to the NRA (registration fee of €32.73 per property, management expenses, blocked listings, lost bookings) may claim damages from the State through a patrimonial liability claim. The deadline is one year from the publication of the ruling in the BOE: until 8 June 2027.

Ongoing NRA applications

There is no need or benefit in continuing any NRA-related procedure. The process has been declared null and void and there is no obligation to correct pending applications.
