Terms & Conditions of Use (includes LSSI-CE Legal Notice)

2. Purpose and scope

These Terms and Conditions govern access to and use of the website andalusiamalaga.com (the "Site") and the services offered through it. Accessing the Site makes you a user and implies full acceptance of these Terms. If you disagree, please do not use the Site.

3. Access and use conditions

Access to the Site is generally free of charge, except for the cost of the user's own internet connection. Users agree to make appropriate and lawful use of the Site, in accordance with applicable law, good faith, public order and these Terms. Fraudulent, unlawful use or use that infringes third-party rights is prohibited.

4. User registration and platform roles

The Site may include different user profile types, including: owner, guest, property manager/operator, and service provider. Each role carries different permissions and responsibilities within the platform. Users are responsible for the accuracy of the data provided at registration and for safeguarding their login credentials.

5. Intellectual and industrial property

All content on the Site (text, images, logos, design, source code, databases) belongs to the owner or to third parties who have authorized its use, and is protected by intellectual and industrial property law. Reproduction, distribution or modification without express authorization is prohibited, except for personal, private use.

6. Limitation of liability

The owner does not guarantee the availability, continuity or error-free operation of the Site, and is not liable for damages arising from interruptions, computer viruses, failures or disconnections, without prejudice to reasonable security measures adopted. The owner is not responsible for the use third parties make of services booked through the platform (e.g., services provided directly by local operators or service providers), where the contractual relationship is established directly between the user and the relevant provider.

7. Third-party links

The Site may include links to third-party websites. The owner assumes no responsibility for the content, privacy policies or practices of such sites.

8. E-commerce (future functionality)

When the Site adds online sale of products or services, the following conditions will also apply:

  • Purchase process: product/service selection, order review before payment confirmation, and email confirmation after purchase, in line with Art. 27 et seq. LSSI-CE.
  • Prices: shown in euros (€) and include applicable VAT, unless stated otherwise.
  • Payment methods: via a secure (PCI-DSS) payment gateway; card data is never stored on our own servers.
  • Right of withdrawal: consumers have 14 calendar days to withdraw from a purchase without justification, under Royal Legislative Decree 1/2007, subject to legal exceptions (e.g., services already fully performed with the consumer's express consent, or bookings for a specific date/service under Art. 103 RDL 1/2007).
  • Invoicing: an invoice or proof of purchase will be issued in accordance with Spanish tax law.
  • Online dispute resolution: EU-resident users can access the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
Before enabling online sales: choose a payment gateway, define a shipping/delivery policy if applicable, define a cancellation policy specific to local service bookings, and confirm VAT treatment with a tax advisor (especially for customers outside Spain/EU).

9. Data protection

Personal data processing arising from use of the Site is governed by our Privacy Policy, available on the Site.

10. Changes to these Terms

The owner may modify these Terms and Conditions at any time. Changes will be published on this page, indicating the last-updated date, and will apply from the date of publication.

11. Governing law and jurisdiction

These Terms are governed by Spanish law. Any dispute shall be submitted to the Courts of Málaga, without prejudice to the venue that may correspond to a consumer under applicable consumer-protection law when the user qualifies as such.
