Andalusian Sustainable Tourism Act — parliamentary process underway

The Draft Andalusian Sustainable Tourism Act, approved by the Governing Council in December 2025, is currently under urgent parliamentary scrutiny. It will replace Act 13/2011 once approved and published in the BOJA. Until then, the current framework remains fully in force: Act 13/2011 + Decree 28/2016 + Decree 31/2024 + Decree-law 1/2025.

The Draft Andalusian Sustainable Tourism Act was approved by the Governing Council of the Junta de Andalucía in December 2025 and submitted to the Andalusian Parliament for urgent scrutiny. It is intended to replace the current Act 13/2011, of 23 December, on Tourism in Andalusia.

Current status (July 2026)

The text is currently at the committee stage with amendments to the articles. Amendments to reject the bill in its entirety were defeated, allowing the process to continue. Parliamentary work has been suspended for the summer recess and is expected to resume in September 2026.

Main planned changes

  • Strengthened penalty framework: very serious infractions for clandestine VUT operation may reach €600,000, compared to the current maximum of €400,000.
  • Extended municipal powers: local councils will have greater tools to restrict or zone VUTs within their municipal boundaries.
  • Strengthened co-governance: formal coordination mechanisms between the Junta de Andalucía and municipalities on tourism planning will be established.
  • Regulatory simplification: the number of implementing decrees required is reduced from 17 to 6, improving legal certainty for the sector.
  • Rights and obligations of all parties: owners, managers, platforms and authorities will be more precisely defined.

Impact of STS 620/2026 on the draft text

The Supreme Court ruling that annulled the national Unique Register (STS 620/2026) directly affects the draft act, which had included a provision to create a new regional registration number. Since the Junta's existing regional VUT register has been confirmed as the sole valid reference point, this provision will need to be removed or adapted during the committee amendment stage.

Until the new act is approved and published in the BOJA, the current regulatory framework remains fully in force:
